Charity Formation and Administration Team
We bring an experienced team to this area of the firm’s practice, headed by our senior partner, Roger Peters, who has been legal consultant to a leading national charity for nearly 25 years. We co-ordinate advice to our charity clients, not only on the technical aspects of charity law, but also on a whole range of other legal problems that charities face day to day, including employment and property issues, and the complexities involved in charity trading.
We now have approaching thirty charity clients, ranging from well known national charities to small private charitable foundations. The service offered by the firm has encouraged the formation of the Charities Group, drawn from different departments of the firm, offering experience and understanding in their own specialist areas of practice when acting for clients in the charity sector.
Charities do not always have the same freedom of action as individual and commercial clients, and it is essential that the legal approach provided is tailored to the particular nature of the charity concerned. We consider this to be a rewarding professional challenge, and have pride in delivering our services in a way which is sensitive to the charity’s values and reputation in the outside world.
We are regularly involved in dealing with compliance issues with the Charity Commission, including registration and de-registration, and applications for a waiver from disqualification of trustees under the Charities Acts.
Despite their status, charities are as much at risk from litigation as any other body, and we have assisted with a wide variety of staff issues, including redundancies and dismissals.
We fully appreciate that the smaller charities are not well placed to meet substantial legal fees, and we are confident in agreeing fixed fee arrangements for constituting and registering new charities, and for specific transactions.
